5 Frivolous Personal Injury Lawsuits that could be Costing All of Us

By: Julie Teep

It has been said that the United States has become a litigious society. Although many personal injury lawsuits that are files in this county are valid, there are numerous frivolous lawsuits filed every year. Below are some of the worst offenders.

Two carpet layers in Ohio sued Para-Chem, an adhesive manufacturer, after both men were burned when a container of carpet adhesive ignited when a hot water heater next to container turned on. Although the container was labeled with warnings including "flammable" and "keep away from heat," the carpet layers stated they were not prepared for the ensuing explosion. A jury awarded the carpet layers $8 million for their injuries.

After fire-walking participants were warned of potential dangers and they agree not to seek legal actions if injuries did occur, one California nudist sued an event organizer when he burned his feet while walking on hot coals.

A woman sued Universal Studios for $15,000 because she claimed the company's Halloween Horror Nights haunted house was too scary. She claimed damages for emotional distress, mental anguish, and extreme fear.

A jury in a New York State court awarded $14.1 million to a woman who was struck by a subway train while she was purposely laying on the tracks trying to commit suicide. Later, the awarded was reduced to $9.9 million because it was believed that the woman was 30 percent responsible for her injuries.

One judge threw out a personal injury case in which a Cleveland man attempted to sue NBC for $2.5 million. The paralegal claimed that he became light-headed and dizzy, then vomited and walked into a door after watching contestants on Fear Factor eat rats.
Unfortunately, as shown above, in several of these frivolous lawsuits, juries awarded the plaintiffs. This phenomenon can cause additional irresponsible lawsuits to be filed, clogging up our court system for serious lawsuits.
